Government's decision to de-register online is invalid

April 14, Kathmandu - The Supreme Court has ordered not to revoke the registration of online media. The online media operation guideline-073 issued by the government had made an arrangement to cancel the registration if it is not renewed after the end of each fiscal year.

A joint bench of Supreme Court Justices Deepak Kumar Karki and Sushmalata Mathema on Tuesday ordered the repeal of the directive issued by the government. "The provision of banning the service of online media which is not renewed within the period of Article 6930 of the Online Media Directive, 073, which is against the provisions of the constitution, is seen as unconstitutional," the order said. '

Lila Nath Ghimire, editor-in-chief of YuvaPost.com, had filed a writ petition at the apex court claiming that the directorate was trying to control the media online and that it would frustrate the right to freedom, equality and communication. The writ petition against the Prime Minister and the Council of Ministers sought repeal of Article 960 of the directive issued by the government.

Sub-section 1 of Article 6930 of the directive stated that the service of online media which does not renew within the period can be stopped as per the law.
