TikTok Urges On 'Unconstitutional' US Ban

Apr 25, Kathmandu- Social media platform "Tiktok" has said it will challenge the 'unconstitutional' US law in court, which includes a provision that requires the company to be sold or face sanctions.

The bill, which was passed by both houses of the US Parliament, has come into effect with the signature of President Joe Biden. According to the new law, ByteDance, the parent company of TikTok, has been given 9 months to sell the TikTok platform in the US, otherwise the TikTok app will be banned in the US.

The United States has implemented this law saying that Tiktok can give the details of users to the Chinese government. However, Tiktok has been denying such allegations. "We believe in the facts and the laws are clearly on our side. Ultimately we will win", TikTok said in a statement, The fact is that we have invested billions of dollars to keep the details of US users safe and our platform is free from external influence and interference". A ban like this would destroy 7 million businesses and silence 170 million Americans.

During the voting on the bill against Tiktok in the Upper House Senate, 79 MPs voted in favor while only 18 MPs remained against.

Republican Senator Marco Rubio of the Intelligence Committee says, "For years, we have allowed the Chinese Communist Party to control one of America's most popular apps. That was a dangerous short-sightedness".

Tiktok has said that ByteDance is not an agent in China or any other country. In addition, ByteDance claims that it is not a Chinese company and that it has 60 percent shares of global investment companies.

The chief executive of the company, Shou Zi Chew, has said that he will make every effort to protect the TikTok platform, including the exercise of legal rights.

According to experts, the new law implemented by the US is a big issue, but there are many obstacles in its implementation.

It may take years for TikTok to be banned according to the law in the US and the matter may even reach the Supreme Court, which will delay this process. Last November, a US federal judge in Montana blocked the move to ban TikTok in that state.

Also, the popularity of TikTok among American youth can also create problems. Two-thirds of young people in America have a TikTok account. The first challenge is to achieve freedom of speech and expression.

Also, according to the United Nations Declaration on the Rights of the Child, children have the right to know information and play. There is a possibility that the American law will be challenged on all these grounds.

According to Jennifer Huddlestone of the Washington-based Cato Institute, potential sales of TikTok could be delayed due to significant regulatory scrutiny.

Another important question is whether selling Tiktok in America is really possible? If so, who will be the buyer?

"Who will actually buy TikTok in the US!" and "whether it will be operated is a big question!". Its value can be tens of billions of dollars. Therefore, the number of potential buyers will be very small.
