Apr 06, Kathmandu - The ongoing debate in the Supreme Court regarding the habeas corpus petition filed by KP Sharma Oli and Ramesh Lekhak, who were detained over allegations of suppressing the Gen-Z movement, continues as the government presents its case.
Deputy Attorney General Sanjiv Raj Regmi, representing the government, clarified before Justices Binod Sharma and Sunil Pokhrel that the arrests of Oli and Lekhak were within legal boundaries. He cited previous Supreme Court rulings affirming that investigations and accountability for incidents related to maintaining peace and security fall under government authority.
Regmi argued that the government’s actions were justified, highlighting an example from the Kumar Poudel murder case in Sarlahi, where the then police chief and district administration officer were held responsible.
He emphasized that, given the political positions held by Oli and Lekhak, they are not entitled to automatic immunity, and the government retains the right to conduct investigations.
Furthermore, the government clarified that there was no bias against Oli and Lekhak, and that the arrests were part of implementing recommendations from the Gaur Bahadur Karki Commission.
Regmi also stressed that legal action taken was not selective or retaliatory.
