Apr 27, Kathmandu - The government has proposed provisions to allow temporary appointments for candidates who pass the Public Service Commission (Lok Sewa Aayog) examinations. The proposal is included in the draft bill related to the formation, operation, and service conditions of the Federal Civil Service.
The draft bill, named the 'Federal Civil Service Act, 2083,' seeks suggestions from relevant stakeholders, according to the Federal Affairs and General Administration Ministry. Section 19 of the draft provides provisions for temporary appointments. Under this draft, the Public Service Commission can publish a separate list of eligible candidates for temporary appointments from among those who did not receive recommendations for permanent positions after examinations.
In cases where temporary appointments are necessary to fill vacant civil service positions, the concerned ministry must submit a written request to the Public Service Commission. Upon receiving such requests, the Commission will recommend candidates from the eligibility list to the relevant ministry for temporary appointment based on their qualifications. These temporary appointments can be made for a period not exceeding one year, until permanent filling of the position. The concerned ministry must inform the Commission of such appointments within seven days.
Any appointment made contrary to this law will require the individual to repay the salary, allowances, and other benefits received during the appointment, which can be recovered as government dues. The law also prohibits hiring personnel on a contractual or casual basis for civil service work. However, positions listed under the fifth category in the Gazette can be filled through service contracts.
The government clarified that, except for specific positions announced in the Gazette, permanent recruitment for fifth-category vacant posts will not be made. Additionally, work for positions outside the main designated roles must be carried out through service contracts.
