May 25, Kathmandu - The Supreme Court is currently hearing petitions challenging the Constitutional Council's decision to recommend Dr. Manoj Kumar Sharma for the position of Chief Justice. The case was brought before a bench led by Justice Meghraj Pokhrel, following a writ petition filed against the decision.
On Baisakh 25, the Supreme Court's Registrar issued an administrative order to 'hold' three writ petitions that challenged the appointment recommendation. The petitions, filed by senior lawyers Dinesh Tripathi, Gita Thapa, and Prem Raj Silwal, requested the court to review the administrative decision to 'dismiss' the petitions and proceed with the registration of Dr. Sharma's appointment after taking the oath.
The petitioners argued that the administrative order to dismiss the writs was unjustified, and they have submitted another petition demanding the court to either hear the case or endorse the dismissal. Once the petitions are dismissed, a final decision on the matter will be made in a joint bench.
Meanwhile, despite the administrative decision to reject the registration of the writs, Dr. Sharma has already been appointed and has assumed his duties as the Chief Justice, appointed by President Ram Chandra Poudel.
